Can rent be charged on the use of an estate's property between the date of death and the start of probate? - death probate
I am very, very firm and can offer help anyone can use.
My father died in early 2002. He and his wife lived in California. Because only married three months before his death had no opportunity to accumulate a large amount of common property. When he died, he owned a house (fully) paid up and two vehicles - all on your behalf.
His wife lived in the house over the past five years. Your daughter is confiscated and destroyed at the head of a vehicle and smashed the second (and).
It took me a while to realize that will never restart the registry, have recently been introduced as administrator of the estate. I try to submit an inventory of cultural heritage properties.
Is it possible the mass of a refund for the use and damage to property have? Can I collect the rent charged to the estate because the house? Be responsible for the destruction of the vehicle from its own negligence?

She did not say if your father left a will, or what he says he has.
In California, if he dies without a will and was married at the time his wife is probably right to at least one third of your property and all their possessions in common. Thus, as co-owner of the building would not be likely to pay rent on the property.
You need to hire a qualified probate attorney to help with that. Lawyers' fees are set by law and are derived from real estate.
You can use part of the company to hire a lawyer who specializes in these matters. Is likely to benefit one's heirs.
Do not tell me what your interest, but I assume that you will benefit from the sale of the house and vehicles. I do not think you can make an impartial administrator.
Ask the Probate Court for the reimbursement of the occupation of the house and the loss of the car. I would also use the compassion for the whole family with regard to the loss of his father.
This is not legal advice, but I had a friend who lived with his grandmother when his grandmother died. The house has had at his aunts and the judge charged for the rent for the months he lived in the house. I think we can do.
